NEW YORK (AP) — Sean “Diddy” Combs was denied bail on Wednesday as he awaits a May sex trafficking trial by a judge who cited evidence showing him to be a serious risk of witness tampering and proof that he has violated regulations in jail. U.S. District Judge Arun Subramanian made the decision in a written ruling following a bail hearing last week, when lawyers for the hip-hop mogul argued that a $50 million bail package they proposed would be sufficient to ensure Combs doesn’t flee and doesn’t try to intimidate prospective trial witnesses. Two other judges previously had been persuaded by prosecutors’ arguments that the Bad Boy Records founder was a danger to the community if he is not behind bars. Lawyers did not immediately respond to messages seeking comment on the decision. Combs, 55, has pleaded not guilty to for years, aided by associates and employees. An indictment alleges that he silenced victims through blackmail and violence, including kidnapping, arson and physical beatings. A federal appeals court judge last month denied Combs’ immediate release while a three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan considers his bail request. Prosecutors have insisted that no bail conditions would be sufficient to protect the public and prevent the “I’ll Be Missing You” singer from fleeing. They say that even in a federal lockup in Brooklyn, Combs has orchestrated social media campaigns designed to influence prospective jurors and tried to publicly leak materials he thinks can help his case. They say he also has contacted potential witnesses through third parties. Lawyers for Combs say any alleged sexual abuse described in the indictment occurred during consensual relations between adults and that new evidence refutes allegations that Combs used his to induce into drugged-up, elaborately produced sexual performances with male sex workers known as “Freak Offs.” Larry Neumeister, The Associated PressNone

No. 8 Kentucky flying high ahead of Western Kentucky meetingClaudio Ranieri insists Atalanta are ‘ready’ for the Scudetto, but his Roma held out well ‘as long as we had the strength’ . ‘We must not surrender to adversity’ The Giallorossi had shown signs of improvement since he took over from Ivan Juric, albeit with a 1-0 defeat away to Napoli and on Thursday. The fatigue from that game ultimately showed as time wore on this evening, with Marten de Roon’s deflected strike from the edge of the area and a late Nicolò Zaniolo glancing header from Juan Cuadrado’s corner sealing the 2-0 Atalanta result. “As long as we had the strength, we answered them blow for blow,” “It is not an excuse, don’t get me wrong, but we played in London on Thursday and returned at 5am. We recovered well, but they were able to make the appropriate changes, whereas I did not have a box-to-box midfielder, as Pisilli was suspended. “I actually congratulated the lads, because at the start of the second half we had a big chance to take the lead, it’s a pity that Dovbyk couldn’t quite get his boot to it, as Dybala had broken their defence. There was another incident with Mancini who was so close in front of goal. “These are moments where if you keep pushing, you will be able to turn those incidents your way. These are the classic games where a team like Atalanta – who we are all very proud of when we see them play in Europe – have everything required to challenge for the Scudetto. I don’t want to put extra pressure on Gasperini, but this team is ready and one of some truly tough sides up there at the top of the table.” Roma will host Lecce next in Serie A, a side still unbeaten under new coach Marco Giampaolo who snatched a last-gasp draw with Juventus last night. “I thanked the team for the way they fought to the final minute, now in December we will play every four days,” added Ranieri. “There are no easy games, I already told them that the next match will be even tougher than this one.” The Giallorossi started to show real fight against Tottenham midweek and Ranieri maintains they are on the right track to rediscovering their spirit. “If the team continues to follow me the way it has been, we will get hold of this situation. We must keep fighting, we must not surrender to adversity. I never accepted a player giving up. We must react and fight for every ball, until we are exhausted, and every substitution I made tonight was caused by exhaustion,” concluded Ranieri. “I congratulate Atalanta on their victory, but also wish to congratulate my team for the performance.”

"Our performance this year reflects a sustained growth trajectory, solidifying our position as one of the top Bitcoin miners in the world, as we move into an anticipated new bull market," said CleanSpark CEO Zach Bradford . "Reflecting on the past year, our results in FY 2024 and the positioning of the company going into 2025 demonstrated the wisdom of our counter-cyclical growth and capital allocation strategy. We produce durable, high performing growth and have been since our earliest days in Bitcoin mining," Bradford said. "CleanSpark has prioritized owned infrastructure as its core foundation, putting us in the best position to optimize our portfolio of data centers to drive ROI to our shareholders as we continue to rapidly deploy additional hashrate on our path to 37 EH by year-end and 50 EH and beyond in 2025." "We anticipated that there would be prime opportunities for M&A paired with organic growth, and over the past year we capitalized by adding 423 MWs to our operating portfolio bringing us to 726 MW, as of today. "Even with the halving event impacting block rewards and a significant increase in difficulty, our production outpaced both, yielding approximately 7,100 BTC thanks to our growth in hashrate and the efficiency improvements to our fleet. "CleanSpark's financial strength continued to grow in fiscal 2024," said Vecchiarelli. Non-GAAP Measure The Company presents adjusted EBITDA, which is not a measurement of financial performance under generally accepted accounting principles in the United States ("GAAP"). The Company's non-GAAP "Adjusted EBITDA" excludes (i) impacts of interest, taxes, and depreciation; (ii) the Company's share-based compensation expense, unrealized gains/losses on securities, and, changes in the fair value of contingent consideration with respect to previously completed acquisitions, all of which are non-cash items that the Company believes are not reflective of the Company's general business performance, and for which the accounting requires management judgment, and the resulting expenses could vary significantly in comparison to other companies; (iii) non-cash impairment losses related to long-lived assets (including goodwill); (iv) realized gains and losses on sales of equity securities, the amounts of which are directly related to the unrealized gains and losses that are also excluded; (v) legal fees related to litigation and various transactions, which fees management does not believe are reflective of the Company's ongoing operating activities; (vi) gains and losses on disposal of assets, the majority of which are related to obsolete or unrepairable machines that are no longer deployed; (vii) gains and losses related to discontinued operations that would not be applicable to the Company's future business activities; and (viii) severance expenses. The Company previously excluded non-cash impairment losses related to digital assets and realized gains and losses on sales of bitcoin from its calculation of adjusted EBITDA, but has determined such items are part of the Company's normal ongoing operations and will no longer be excluding them from its calculation of adjusted EBITDA. Management believes that providing this non-GAAP financial measure that excludes these items allows for meaningful comparisons between the Company's core business operating results and those of other companies, and provides the Company with an important tool for financial and operational decision making and for evaluating its own core business operating results over different periods of time. In addition to management's internal use of non-GAAP adjusted EBITDA, management believes that adjusted EBITDA is also useful to investors and analysts in comparing the Company's performance across reporting periods on a consistent basis. Management believes the foregoing to be the case even though some of the excluded items involve cash outlays and some of them recur on a regular basis (although management does not believe any of such items are normal operating expenses necessary to generate the Company's bitcoin related revenues). For example, the Company expects that share-based compensation expense, which is excluded from adjusted EBITDA, will continue to be a significant recurring expense over the coming years and is an important part of the compensation provided to certain employees, officers, and directors. Additionally, management does not consider any of the excluded items to be expenses necessary to generate the Company's bitcoin related revenue. The Company's adjusted EBITDA measure may not be directly comparable to similar measures provided by other companies in our industry, as other companies in the Company's industry may calculate non-GAAP financial results differently. The Company's adjusted EBITDA is not a measurement of financial performance under GAAP and should not be considered as an alternative to operating (loss) income or any other measure of performance derived in accordance with GAAP. Although management utilizes internally and presents adjusted EBITDA, the Company only utilizes that measure supplementally and does not consider it to be a substitute for, or superior to, the information provided by GAAP financial results. Accordingly, adjusted EBITDA is not meant to be considered in isolation of, and should be read in conjunction with, the information contained in the Company's consolidated financial statements, which have been prepared in accordance with GAAP.
